Thank you for using Dino Planet. We hope you would take the time to read and understand the terms of the legal agreement between you and the product Dino Planet by 1EDTECH PTY LTD. By accessing, browsing, or otherwise using any content or images of this product, you acknowledge that you have read, understood, and agreed to comply with the rules set out in these terms. Dino Planet is responsible for ensuring the legitimacy of delivering content in the product to users.

Please read these Terms and Conditions (Terms) and our Privacy Policy carefully as they apply to your use of our Services. Do not purchase a subscription, sign up for an account, purchase anything in our online store or use the Services if you do not agree to these Terms. These Terms define users of the Services to include both Child Users and Adult Users. Child Users refer to children who use the child-directed learning portion of the Services, as well as any specific functionalities of our products and/or services. Adult Users, on the other hand, are individuals over the age of 18, including parents and guardians of Child Users, teachers, and school administrators. We collectively refer to all users as "you," "your," or "users." If you are below 18 years of age, you may use the Services only with the consent of an Adult, who may be your parent, legal guardian, teacher, or school administrator authorized to act on behalf of your parent or legal guardian. Before using the Services, please ensure that an Adult has reviewed and explained these Terms to you. If you are an Adult providing consent for a user under 18 years old to use the Services, you acknowledge that you have the authority to do so and that you will ensure that the child uses the Services in compliance with these Terms.

1. Your Account and Password

Before using the Services, you need to create a Dino Planet account (Account) and agree to our Terms and Privacy Policy. Only Adult Users can create an Account, and Child Users can access the Services using an Adult User's Account. If you have a Dino Planet Account, you can also access the Services through Dino Planet Unlimited/Plus, a subscription-based service that provides access to all content and specific features within the Services. However, your access to Dino Planet Unlimited/Plus is only valid while your subscription is active. Passwords and Account Access. Every Account must have one designated Adult User who is at least 18 years old and authorized to enter into a contract with us under the applicable law. It is your responsibility to keep your password and Account information confidential. You agree to (a) provide accurate registration information about yourself and any authorized individuals accessing your Account, (b) assume full responsibility for all activities that occur under your Account, (c) report any unauthorized use of your Account promptly, (d) acknowledge that we are not liable for any losses resulting from unauthorized use of your Account or password, and (e) not sell, transfer, or assign your Account or any Account rights. If we discover that an ineligible user has created an Account, we may verify their status and deactivate the Account.

2. Purchases or fees

2.1. Dino Planet will inform you of all Fees that Dino Planet may charge you through your Dino Planet Account. We may, at our discretion and with prior notice to you, adjust existing Fees or introduce new Fees. You are responsible for paying all Fees, as adjusted by us from time to time, and your continued use of the Dino Planet Services indicates your acceptance of such Fees. We will publish the updated Fees in your Dino Planet Account portal and may send you an email notification (if required) when we adjust our Fees. If you have any questions or concerns about Fees, please contact Dino Planet Customer Support.

2.2. Fees payable by you will be deducted from your Payment Account at the time of executing the Transaction. By using the Dino Planet Services, you authorize us to deduct the Fees from your Payment Account.

2.3. Your Transaction may involve currency conversions. If this is the case, the conversion will be made at the foreign exchange rate determined by Dino Planet at the time of the Transaction, in accordance with applicable law. To avoid the impact of fluctuating exchange rates, foreign exchange rates for each Transaction will be determined when the Transaction is processed by Dino Planet. Therefore, and subject to applicable law, the foreign exchange rate provided by Dino Planet before executing the Transaction is for reference only, and the actual foreign exchange rate at the time of the Transaction will apply. By using the Dino Planet Services, you acknowledge and agree to be bound by the applicable exchange rates from time to time.

3.Termination and Suspension

To terminate your Dino Planet Account, you can stop using the Dino Planet Services. This Agreement will end on the date when you close your Dino Planet Account and stop using Dino Planet's Services. However, provisions related to ownership, representations and warranties, indemnity, jurisdiction and venue, and limitations of liability will survive the termination of this Agreement. Dino Planet may suspend or terminate your access to all or part of the Dino Planet Services at any time, with or without cause. Whenever possible, we will provide at least seven (7) days' prior notice by email, unless there are exceptional or regulatory circumstances (such as court or governmental orders) that require immediate action. We may take immediate action, such as if we discover that you have provided false, misleading, incomplete, inaccurate information, or have acted dishonestly, or if you breach this Agreement or any other agreement with Dino Planet, or if your Dino Planet Account has been compromised or for other security reasons, or if you engage in fraud, money laundering, terrorist financing, or other illegal activities, or if you use Dino Planet Services illegally or fraudulently in violation of applicable law, or if there are other valid reasons that Dino Planet considers appropriate.

4. Security Use of Dino Planet Services

To prevent any loss, theft, misappropriation, or unauthorized use of your Dino Planet Account, you must ensure the security of all IDs, passwords, and Account Credentials, as well as your computer, mobile phone, or other device. If you become aware of any loss, theft, misappropriation, or unauthorized use of your Dino Planet Account, you must immediately notify us by sending an email to [email protected].

5. Protection of Your Data

We will ensure that all your personal information is held in accordance with applicable data privacy and security laws and our published Privacy Policy. By using the Dino Planet Services, you agree to our Privacy Policy, which you can find on our website. Please review our Privacy Policy to familiarize yourself with how we handle your personal information. Dino Planet may amend the Privacy Policy at any time, and such changes will be reflected on the Privacy Policy page of the Dino Planet website. Personal information such as address, email, phone number of Dino Planet users (which users voluntarily provide in different forms on the website) can be used internally for the purpose of upgrading the products and services of Dino Planet. Dino Planet commits not to actively disclose any user information to third parties, except in cases where there is a written request from investigation units in accordiance with the current law. At that time, Dino Planet will notify the user through a written document. However, although our system is equipped with several security measures and funcstions, no data transmitted over the Internet can be 100% secure. Therefore, Dino Planet cannot make a firm commitment that the information you provide to us will be absolutely confidential, nor will we be responsible in the event of unauthorized access to personal information of users. You acknowledge and agree that Dino Planet may access and disclose your personal data to third parties in compliance with applicable laws and lawful requests from government or other regulatory authorities, or to provide Dino Planet Services or protect Dino Planet, its customers, or other users.

6. Services Ownership and License

6.1. Ownership. We own and control the Services, including any specific functionalities of our products and/or Services (past, present, and future versions), and all Content related to the Service (as defined below) is protected by national and international copyright, trademark, patent, and other intellectual property rights and laws to the fullest extent possible. Content includes all text, graphics, user interfaces, visual interfaces, photographs, logos, sounds, music, artwork, and computer code available through the Services and the design, structure, selection, coordination, expression, and arrangement of such materials, including, without limitation, (i) materials and other items relating to us and our products and services, such as all activities, games, lesson plans, teacher trainings, printables, characters, photographs, audio clips, sounds, pictures, videos, and animations; (ii) trademarks, logos, trade names, service marks, and trade identities of various parties, including ours (collectively, Trademarks); and (iii) other forms of intellectual property.

6.2. Limited License. Provided you strictly comply with these Terms and pay any applicable subscription or other fees, we grant you a limited, non-exclusive, revocable, non-assignable, and non-transferable license (License) to access, display, view, use, play, and/or print one (1) copy (excluding certain printable activities made available through the Services, which indicate that they may be printed multiple times) of the Content on a personal computer, mobile phone, or other Internet-enabled device (each, an Internet Device) for your personal, non-commercial use only. For example, teachers may use Content from the Services, including any specific functionalities of our products and/or Services, to educate their students, and other users' use is limited to personal use. The License does not grant you ownership of, or any other intellectual property interest in, any Content or the Services or any specific functionalities of our products and/or Services, and you cannot use the Content or the Services without our express prior written permission. We and/or our licensors and other third parties reserve all rights not expressly granted to you. Except as provided in these Terms or with our express prior written consent, you may not use, copy, reproduce, distribute, upload, post, publicly display, translate, modify, transmit, broadcast, sell, license, or otherwise exploit any part of the Services or any Content for any purpose whatsoever. Any unauthorized use of any Content or the Services is prohibited.
